Brazil is a country of continental dimensions and extremely rich in natural resources, and one of the most abundant is sunlight. Solar energy has been gaining ground in our country, and one of the reasons for this growth is the tax incentive policy aimed at making PV systems more accessible. In this article, we will explore how solar energy is taxed and the tax benefits offered by the federal, state and municipal governments.
Taxation of Solar Energy in Brazil
In Brazil, the taxation of solar energy involves tax incentives and exemptions to promote renewable energy. These include benefits on Corporate Income Tax (IRPJ), Social Contribution on Net Profit (CSLL), PIS/COFINS and the Tax on the Circulation of Goods. ICMS varies from state to state, with 23 states and the Federal District exempting PV systems of up to 1 MW. The Federal Government has also exempted solar energy injected into the grid from PIS/COFINS. Solar energy companies can opt for the Simples Nacional regime, provided they meet the annual gross revenue requirements and the characteristics of the solar business. The legal framework for distributed generation establishes an exemption from charges until 2045 for those who had already installed their system before its publication or install it within 12 months after the Law.
Tax Benefits of Solar Energy
Solar energy tax benefits are measures created by the federal, state and municipal governments to encourage solar power generation. The main benefits include:
PIS/COFINS exemption: Under Law No. 13.169, solar energy injected into the grid and active energy credits originating at the consumer unit itself are exempt from the PIS/Pasep Contribution and COFINS, resulting in discounts on the electricity bill.
ICMS exemption: CONFAZ Agreement 16/2015 authorizes states to grant an ICMS exemption on electricity supplied by the utility to the consumer unit, provided it corresponds to the sum of the electricity injected into the distribution grid and the active energy credits originating at the same consumer unit.
IPTU discount: Municipalities such as Cuiabá, Curitiba, Goiânia, Manaus, Palmas, Porto Alegre, Rio de Janeiro and Salvador offer discounts on the Urban Property and Land Tax (IPTU) for properties that adopt sustainable solutions, including solar power generation. To take advantage of this benefit, it is important to check whether your municipality offers the Green IPTU by consulting the city hall’s official website.
Inclusion in the Minha Casa, Minha Vida program: The new Minha Casa Minha Vida, as established by Law 14.620 of 2023, includes the possibility of linking the installation costs of PV equipment to the housing program’s financing lines.
Import Tax exemption: The federal government has reduced Import Tax rates for solar energy equipment, making it more affordable to import these products.
Reduced Income Tax on the Sale of Property: A solar PV generation system installed in a home can be declared on the Income Tax return as a renovation and improvement to the property, reducing the calculation base for capital gains tax on a potential sale.
Solar energy in Brazil is gaining more and more prominence, and the tax benefits and incentives offered by the federal, state and municipal governments play a crucial role in this growth. In addition to savings on the electricity bill, solar power generation helps reduce environmental impact, increases property value and generates systemic benefits for the power sector. So, if you already have or are considering installing a solar energy system, it is important to know the tax benefits available and take advantage of these opportunities to make solar energy even more accessible and sustainable in Brazil.
Now that you are aware of these benefits, be sure to check the specific laws and regulations in your region to take advantage of the tax incentives available for solar energy. Together, we can contribute to a cleaner and more sustainable future. Investing in solar energy is a smart choice for your wallet and for the planet.
